1. Acceptance of Terms
By downloading, installing, or using the Velo Grupetto mobile application or visiting velogrupetto.com (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Mile High Sandbox LLC ("we," "our," or "us"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Velo Grupetto is a mobile application that connects cyclists with local group rides and cycling communities. The Service allows users to discover and join cycling groups, organize and RSVP to rides, and communicate with fellow riders through group chat.
3. Account Registration
To use the Service, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Be at least 13 years of age
You are responsible for all activity that occurs under your account.
4. User Conduct
When using the Service, you agree not to:
- Post content that is abusive, threatening, obscene, or otherwise objectionable
- Harass, intimidate, or bully other users
- Impersonate any person or entity
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or its infrastructure
- Spam or send unsolicited messages to other users
We reserve the right to remove content and suspend or terminate accounts that violate these Terms.
5. Group and Ride Content
Users who create groups and organize rides are responsible for the accuracy of the information they provide, including meeting points, times, routes, and pace descriptions. Velo Grupetto does not verify or endorse any user-created content.
6. Assumption of Risk
Cycling involves inherent risks including but not limited to physical injury, property damage, and exposure to weather conditions. By using the Service to find and join group rides, you acknowledge and accept these risks. Velo Grupetto is a communication platform that connects riders; we do not organize, supervise, or control any rides. You are solely responsible for your own safety while riding.
7. SOS Feature Disclaimer
The Service includes an "SOS" feature that allows users to broadcast a request for roadside assistance to other nearby app users. This feature is NOT an emergency service, does NOT contact 911 or any emergency dispatcher, and is NOT a substitute for calling emergency services. If you are in danger or experiencing a medical emergency, call 911 or your local emergency number immediately.
The SOS feature is a best-effort, peer-to-peer communication tool. We do not guarantee that:
- Any other user will see, receive, or respond to your SOS request
- Push notifications will be delivered successfully or in a timely manner
- Other users will be nearby, available, or able to provide assistance
- Location data will be accurate or available at the time of your request
- The feature will function without interruption due to network conditions, device settings, or other technical factors
By using the SOS feature, you acknowledge that it is an informal community tool — comparable to flagging down a passing cyclist — and you agree not to rely on it as your sole or primary means of obtaining help in an emergency. You assume all risk associated with using or relying on the SOS feature.
8. Intellectual Property
The Service and its original content (excluding user-generated content) are the property of Mile High Sandbox LLC and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you create (messages, images, group descriptions) but grant us a license to display and distribute that content within the Service.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy or completeness of any information provided through the Service, including ride details, meeting locations, or user profiles.
11. Limitation of Liability
To the maximum extent permitted by law, Mile High Sandbox LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to personal injury, property damage, or data loss. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $50, whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless Mile High Sandbox LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your participation in any group ride discovered through the Service; or (d) your use of or reliance on the SOS feature.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes through the app or by updating this page. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.
